Regulations for the Provision of Electronically Supplied Services
General Provisions
- These Regulations set forth:
- the type, scope and terms of provision of electronically supplied services by eBilet Polska Sp. z o.o.;
- the rights and obligations of the Users and the Service Provider.
- These Regulations do not apply to e-store services. The regulations for buying tickets in the eBilet® distribution system are available at https://www.ebilet.pl/regulamin/.
- For information on the processing of personal data for the purposes of provision of the Services please see <Privacy Policy> available at https://www.ebilet.pl/polityka-prywatnosci/ .
- Whenever these Regulations refer to the following phrases, they should be understood as follows:
- eBilet – Service Provider
- Partner – a third party with which eBilet has established business cooperation with respect to the offered products, services or promotional actions;
- Regulations – these Regulations for the provision of electronically supplied services – the ebilet.pl website
- Website – the ebilet.pl website and all of its subsites
- Service Provider – eBilet Sp. z o.o. with its registered office in Warsaw
- Services – services supplied electronically in accordance with these Regulations
- User – each person visiting the ebilet.pl website
Services
- eBilet provides electronically supplied services via the ebilet.pl website:
- Web Service;
- Fan Alert Services;
- Newsletter Services;
- Contact Form Services;
- Reservation Service.
- The Web Service consists of:
- Making available content and information about eBilet, the scope of activity of eBilet, information related to the products and services being rendered;
- Making available information about the services rendered by eBilet or Partners, special offers and promotions;
- Making available links / cross-references to the Partners’ sites, social networking sites, eBilet Fanpage, other places related to the rendered services and products;
- The Newsletter Services consist of:
- Cyclical dispatch of commercial information to the e-mail address indicated by the User;
- The Newsletter contains promotional and marketing information of the Service Provider and its Partners, including but not limited to the news, interesting facts, information about promotions, competitions, products and services;
- The Fan Alert Services consist of:
- Cyclical dispatch of selected commercial information to the e-mail address indicated by the User;
- The Fan Alert contains information concerning news within the selected area of interest of a particular User;
- The Contact Form Services consist of:
- Making it possible to send electronic mail to the Service Provider directly from the Website, without having to log into the User mail box;
- Responses to the questions addressed to the Service Provider using the Contact Form will be sent directly to the e-mail address indicated by the User;
- The Reservation Service consists of:
- Informing of the services rendered by the Partners, which may be realized via the Service Provider;
- Intermediation in looking for and reservation of the Partners’ services in the vicinity of the event for which the User purchased tickets, e.g. accommodation, transport, restaurants.
Execution and Termination of the Agreement for the Provision of Electronically Supplied Services
- Upon commencement of the use of the Services one will be deemed to have entered with the Service Provider into an agreement for the provision of electronically supplied services. Prior to the execution of an agreement for the provision of electronically supplied services the User is obliged to become familiar with these Regulations.
- The agreement is executed upon opening the eBilet.pl website or any of its subsites or through granting consent to the dispatch / subscription to the Newsletter or Fan Alert.
- The agreement for the provision of electronically supplied services is executed for the period of rendering such services, i.e.:
- In respect of the content at the eBilet.pl website – until the eBilet.pl website is closed;
- In respect of the contact form – upon dispatch of the message or leaving the contact form;
- In respect of Fan Alert and Newsletter – upon withdrawal of the consent or resignation from subscription.
- Execution of the agreement for the provision of electronically supplied services does not involve any fees payable to the Service Provider by the User.
- The Customer may use the services anonymously, without disclosing any personal data, except for the contact form. In order to use the Newsletter and Fan Alert one must provide one’s e-mail address, which may constitute personal data and together with other information held by the Service Provider may lead to identification of a natural person; however, no personal data is required to render the Newsletter and Fan Alert services.
- In order to use the functions of the contact form the User must indicate his/her name, surname, e-mail address, the subject of the inquiry and content thereof, and on a voluntary basis – also the telephone number.

Terms and Conditions of Use of the Services
- The Customer is prohibited from providing any illegal or misleading content, and from taking any actions which may cause any disturbance or damage to any IT systems of the Service Provider.
- eBilet shall not be liable for any consequences of the Customer using the Services in any manner contrary to the generally applicable laws, the principles of community life or the provisions of these Regulations.
- The Service Provider shall render the services continuously, subject to any maintenance breaks arising from the need to carry out any maintenance, modernization or service works.
- The provision of the Services involves the placement of links to services of other entities (e.g. Facebook, youtube, twitter, the Partners’ websites). The Service Provider shall then be only responsible for the provision of Services in respect of placement of appropriate links and shall not be responsible for any services rendered by other entities, to which links are made available by the Service Provider as part of the Services.
- In the event of any suspicion that the User breaches the Regulations or the provisions of Polish law, the Service Provider has the right to suspend the Services and take actions intended to clarify all material circumstances concerning any breach. The Service Provider reserves the right to cease to provide the Services to the User who breaches any of the provisions of the Regulations. Resumption of Services depends on the Service Provider’s decision.
- The User shall not have any financial or non-financial claims in the case of any interruption of the Services caused by the above-mentioned circumstances.
- The Services are informative in nature. The Service Provider does not give any warranty of fitness of the content being published or sent for a particular purpose or application, or its being adequate for the interests of a particular User. In particular, the Service Provider does not guarantee that such contents, logos, links or communications placed or conveyed via the Website are up-to-date, accurate, reliable, complete and appropriate.
- The Website and all of its elements are protected by law, in particular the Act on Copyrights and Related Rights and the Act on Combating Unfair Competition.
- The Customer undertakes to use the eBilet website with respect for intellectual property rights. The use of any content placed on the website does not mean that the Customer acquires any rights to the works or data bases included therein.
Technical Requirements Necessary to Use the Services
- In order to correctly use the services it is necessary to have computer equipment with installed internet browser making it possible to open websites and access to the Internet. The method of displaying the Website, its parts or visibility of particular sections may differ or depend on the browser version, installed plugs or operating system, which is used by the User. The differences do not denote incorrect provision of the Services.
- In respect of the contact form, Newsletter and Fan Alert, it is also necessary to have an active e-mail account.
Complaint Procedure
- Users shall have the right to submit complaints concerning the provision of the Services.
- A complaint may be any reservation or comment concerning the provision of Services.
- Complaints should be submitted to the following e-mail address: rezerwacje@ebilet.pl or in writing to the following address of the Service Provider: eBilet Polska Sp. z o.o., ul. Żelazna 51/53, 00-841 Warszawa.
- The Service Provider shall review complaints within 30 days and send its response to the e-mail address from which the complaint was received, unless the User submitting the complaint indicated another address (regular mailing address or e-mail address) for responding.
- Complaints should contain all information which makes it possible to review them. If in order to review a complaint it is necessary to obtain any additional information, the Service Provider will contact the User submitting the complaint to supplement such information.
- A complaint may be submitted anonymously, i.e. without indicating any data concerning the User’s identity, if it is not necessary in order to review the complaint and give a response.
- Any complaint reviewed in accordance with these Regulations shall not be subject to further review.
Final Provisions
- The Service Provider reserves the right to change the Regulations for the following important reasons:
- due to any change of the generally applicable laws,
- in order to fulfill any obligation arising from the legally binding court ruling or administrative decision,
- for safety reasons, in particular in order to prevent the use of the Services in any manner contrary to the provisions of law or the Regulations,
- due to the introduction of any material changes to the operation of the Website or any of the Services, including any changes related to the technical and technological progress, and in particular in the situation in which any new Services start to be provided, new functionalities are made available or the existing Services or functionalities cease to be provided which significantly changes the scope of the Services being rendered.
- Each and any change will be announced through the publication of new Regulations at the eBilet.pl website.
- Users of the Newsletter and Fan Alert Services will also be separately and individually informed of any amendment to the Regulations by a message sent to the e-mail address used to provide the Services.
- If the User does not accept the new Regulations, the User shall be entitled to rescind the agreement for the provision of the Services within 14 days. Within such period one should notify the Service Provider of the rescission of the agreement by sending a message to the following address: rezerwacje@ebilet.pl.
- The generally applicable Polish laws, and in particular the Civil Code and the Act on Provision of Electronically Supplied Services shall apply to matters not regulated herein.
- Polish courts shall have jurisdiction to resolve any disputes between the Service Provider and the User.
- Notwithstanding the foregoing, the Service Provider declares that it is willing to use out-of-court methods of settlement of disputes with the Users, in particular in accordance with the procedure set out at: www.uokik.gov.pl.
- The Client being a consumer shall also be able to use the ODR platform, available at: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=PL.
- These Regulations shall enter into force on 1 October 2022.
